100% declared property protects the buyer: the advertised price is exactly the price in the notarial deed.
In Morocco, part of a property’s price is sometimes still paid “under the table”: in cash, outside the notarial deed. More and more buyers refuse this and look for 100% declared projects, where the advertised price is exactly the price in the deed signed at the notary.
In this guide we explain why this matters and present the projects in Tangier that work this way.
100% declared property: what does it mean?
The full price of the property appears in the contract and in the deed of sale. You pay everything by bank transfer or cheque, traceably, with no cash amount on the side. Nothing more, nothing less.
Why it is in your interest
- Bank financing: the bank lends on the declared price. If part is paid in cash, you have to find that amount yourself.
- Resale: capital gains tax (TPI) is calculated on the difference between the sale price and the declared purchase price. An under-declared purchase price means a higher gain, and therefore more tax when you sell.
- Legal protection: in a dispute, only what is in the deed counts. A cash payment is very hard to prove.
- MRE and foreigners: to be able to transfer the proceeds of a sale abroad later, the purchase must in principle have been financed in foreign currency or convertible dirhams and be documented. The cash part cannot be.
- Tax audit: the tax authority can challenge an obviously undervalued price and claim additional duties.
The only “benefit” of cash, slightly lower registration fees on the day you buy, is small compared with these risks.

How to check that a project is really 100% declared
- The full price is written in the reservation or preliminary contract.
- All payments are made by transfer or cheque, with a receipt for each instalment.
- Nobody asks you for an amount “on the side”, before or on the day of signing.
- The notary confirms that the price in the deed matches the agreed price.

Is a 100% declared property more expensive?
The advertised price may look higher, but you pay nothing extra in cash. In total you often pay the same, with far less risk.
Can I get a mortgage or a Murabaha?
Yes. It is actually easier with a 100% declared property, because the bank finances the price in the deed.
Does the buyer pay Levana?
